  1. SIERRA DIVING ADVENTURE screen saver is a real-time 
  2. 3D simulation of an undersea environment that allows 
  3. you to swim with the fishes. It is a prototype for a 
  4. product being considered for development at Sierra.  
  5. We welcome any feedback you may wish to provide that 
  6. will help us to make Diving Adventure a truly

  13. IMPORTANT
  14. You must accept the terms in the license agreement at 
  15. the end of this document prior to installing this 
  16. software. Please read them carefully.  Installing this 
  17. software indicates that you agree to the terms of the 
  18. license.

  20. INSTALLATION
  21. 1. Copy Diving.scr, Diving.wav, Diving.ted and 
  22. Diving.vol into your Windows directory.
  23. 2. Right click on the Win '95 desktop and select 
  24. "properties".
  25. 3. Select "Screen Saver" and go through the setup 
  26. procedures as usual.  "Diving" will be one of the 
  27. selections in the screen saver list box.

  29. NOTE:  There is no PASSWORD option in this screensaver.
  30.        Checking the Password box will do nothing.
  31.  
  32. DIVING requires 2.3 meg of free HD space.
  33.  
  34. CONTROLS
  35. DIVING is an INTERACTIVE screen saver which allows 
  36. you to either control your movement through the water 
  37. or sit back and watch in "fish cam" mode. Movement is 
  38. controlled with the mouse. Forward and reverse speed 
  39. is controlled with the left and right mouse buttons 
  40. respectively. The longer the mouse buttons are 
  41. depressed the faster you will go. If you become lost or 
  42. disoriented simply release the mouse for 10 seconds 
  43. and you will be returned to the starting position.  To end 
  44. the screen saver, press a key on the keyboard.

  48. USER AGREEMENT
  49. NOTE:  By using the "Diving" program (the "Program"), 
  50. you signal your acceptance of the following terms and 
  51. conditions.  If you do not agree to these terms and 
  52. conditions, you may not use this Program in any 
  53. manner.

  55. License.  Sierra grants you, the end-user, a revocable, 
  56. nonexclusive, nontransferable license to use this copy of 
  57. "Diving" program (the "Program"), in object code form only, 
  58. on your personal computer.  You may not: (a) disassemble, 
  59. reverse engineer, recompile, decompile or otherwise attempt 
  60. to discover the source code of the Program; (b) make any 
  61. adaptation, modification, improvement, enhancement or 
  62. derivative of the Program; (c) reproduce or distribute the 
  63. Program; (d) remove, obscure or alter any notice of 
  64. copyright or other proprietary right present on or in the 
  65. Program; (e) use the Program to develop any other 
  66. computer programs; or (f) permit or authorize anyone else to 
  67. take any action described in this sentence.  Sierra may 
  68. revoke this license at any time by written notice.
  69. Ownership.  All patent, copyright, trademark, trade secret 
  70. and other proprietary rights in and to the Program are 
  71. retained by Sierra and are not sold or transferred to you.
  72. Disclaimer.  You acknowledge that the Program is provided 
  73. "AS IS" and "WITH ALL FAULTS, DEFECTS AND 
  74. ERRORS" and that all use of the Program is AT YOUR 
  75. OWN RISK.  Accordingly, SIERRA WILL NOT HAVE ANY 
  76. OBLIGATION OR BE LIABLE FOR ANY:  (A)  VIRUS, 
  77. BUG, ERROR, OMISSION, DEFICIENCY OR DEFECT IN 
  78. THE PROGRAM; (B) INABILITY TO USE THE PROGRAM; 
  79. (C)IMPLIED WARRANTY OF MERCHANTABILITY OR 
  80. FITNESS FOR A PARTICULAR PURPOSE; OR (D)CLAIM 
  81. IN TORT, WHETHER OR NOT ARISING IN WHOLE OR IN 
  82. PART FROM SIERRA'S FAULT, NEGLIGENCE, STRICT 
  83. LIABILITY, OR PRODUCT LIABILITY (WHETHER 
  84. ACTIVE, PASSIVE OR IMPUTED).
  85. LIMITATION OF DAMAGES.  IN NO EVENT WILL SIERRA 
  86. HAVE ANY OBLIGATION OR LIABILITY (WHETHER IN 
  87. CONTRACT, WARRANTY, TORT (INCLUDING 
  88. NEGLIGENCE) OR OTHERWISE FOR COVER OR ANY 
  89. DAMAGES SUSTAINED BY YOU OR ANY OTHER 
  90. PERSON ARISING FROM USE OR INABILITY TO USE 
  91. THE PROGRAM, INCLUDING WITHOUT LIMITATION 
  92. ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR 
  93. CONSEQUENTIAL DAMAGES (INCLUDING FOR LOST 
  94. PROFITS AND LOST DATA), EVEN IF SIERRA HAS 
  95. BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  96. DAMAGES.

  98. Applicable Law.  THIS AGREEMENT SHALL BE 
  99. INTERPRETED, CONSTRUED AND ENFORCED IN ALL 
  100. RESPECTS IN ACCORDANCE WITH THE LAWS OF THE 
  101. STATE OF WASHINGTON WITHOUT REFERENCE TO 
  102. ITS CHOICE OF LAW RULES.

  104. Entire Agreement.  This User Agreement sets forth the 
  105. entire agreement, and supersedes any and all prior 
  106. agreements, with respect to the Program.
